Terms of Use and Data Processing Policy for the Platform

Using the platform — this platform as a website and the services implemented through it — requires familiarization with and agreement to the terms of use and the terms of data processing — both non-personal and personal data — when using the platform. By confirming registration, the user agrees to these terms, consents to the processing of non-personal and personal data, and authorizes such processing.

The platform is not a legally or organizationally separate, independent, or self-sufficient service — it is a tool for implementing projects aimed at providing urgent assistance to populations in Ukraine affected by the war and supporting artistic projects. These projects are implemented with financial support from the European Union and other donors, considering that the implementation is only possible due to such financial support, which comes with specific conditions and requirements that are not determined by the IZOLYATSIA Foundation. This means the platform will be used by IZOLYATSIA, you, and other users like you in this context. It also means that the data you provide, along with data from other users like you, will be collected and used accordingly.

Due to circumstances associated with martial law, which are beyond the effective control of IZOLYATSIA, and just as it was impossible to foresee such circumstances before February 24, 2022, it remains impossible to predict other similar future circumstances. Therefore, IZOLYATSIA cannot guarantee full compliance with all requirements of current Ukrainian legislation, including the Law of Ukraine "On Personal Data Protection," as it cannot ensure such compliance under these existing and potential future conditions.

IZOLYATSIA respects the right to privacy, confidentiality, and protection of data obtained through the platform. However, the platform is intended for legal entities under public or private law, individual entrepreneurs, and independent professionals — not for ordinary citizens, although the platform's positive outcomes are expected to benefit communities and individuals in difficult life situations. Additionally, the legal regime of martial law and its associated circumstances significantly affect the platform and its services. IZOLYATSIA would prefer not to process any data at all, but this would complicate or even make it impossible to operate the platform and deliver its services. IZOLYATSIA could focus on strictly complying with every conceivable requirement and minimizing all risks to zero, but that would defeat the purpose of the platform, which is to deliver results here and now. If you do not agree with these principles, simply stop the registration process and do not confirm it. In any case, IZOLYATSIA takes all necessary measures to preserve data confidentiality and security, including the use of industry-standard technological and operational protections against possible loss, misuse, alteration, or destruction of data. However, due to the nature of the digital space and its inherent threats — which often arise before effective countermeasures are developed — IZOLYATSIA cannot guarantee absolute data protection, although it will do everything in its power to keep the data as secure as possible.

The purpose of data processing is the effective implementation of IZOLYATSIA’s projects to provide urgent assistance to war-affected populations in Ukraine and to support artistic initiatives. However, data processing goals may also be influenced by the requirements of Ukrainian law, the European Union, and other donors. IZOLYATSIA cannot rule out the impact of requirements, actions, or inactions — legal or illegal — from government bodies, local authorities, and their officials on the purpose and process of data processing.

IZOLYATSIA collects various types of data, including those explicitly listed below and others not mentioned, as much depends on how each user interacts with the platform — technically and contextually — and on the wide variety of life situations and circumstances in which the platform is used. In any case, IZOLYATSIA collects only the data that is directly or indirectly necessary for project implementation. Similarly, data is used and processed only if directly or indirectly required for the implementation of such projects.

Creating an account to use the platform requires providing a name, email address, organizational affiliation, organization type, and position. Additional personal information may be required to determine user interest and process requests, applications, or forms submitted by the user, whether acting individually or as a representative of a legal entity. IZOLYATSIA may also require contact or identification data through feedback forms, newsletter subscriptions, etc.

Depending on how the platform is used, the data may include:

  • The name or full name — surname, first name, patronymic, etc. — of the user as a requester/applicant or their representative;
  • The user’s phone number, whether as a requester/applicant or their representative;
  • The user’s email address, whether as a requester/applicant or their representative;
  • The name of the legal entity represented by the user as a requester/applicant;
  • The name of the territorial community represented by the requester;
  • Anonymized statistical information about the community — population size, number of internally displaced persons, those in need, gender, age ranges, disability status, etc.;
  • The identification code of the legal entity represented by the user as a requester/applicant;
  • The identification code of the individual requester/applicant;
  • The address of the legal entity represented by the user;
  • The registered place of residence, place of stay, or actual residence of the individual requester/applicant;
  • Supporting documents for a request for charitable assistance, provided by the requester or third parties;
  • Reports from requesters as beneficiaries of charitable aid — documents confirming receipt/distribution of aid, photos, accompanying materials, etc. — including data on the final beneficiaries;
  • Supporting documents for subgrant applications, from the applicant or third parties;
  • Reports and financial statements from applicants regarding subgrant use, with supporting documents — contracts with art project implementers, photos, visitor demographics (gender, age, etc.) — including visitor data;
  • Any other information, documents, or materials, depending on the requester’s/applicant’s actions or inactions, and the circumstances under which requests or applications are submitted.

IZOLYATSIA collects access-related data from users and similar users when visiting the platform’s website. This may include browser information, visited pages, date and time of visits, duration, device identifiers, diagnostic data, etc.

Cookies are used to collect such website access information. Details can be found at https://aboutcookies.org. Cookies are small files stored on users' devices during website access. They store website settings per user — account ID, language, font sizes, search settings, etc. — to ease future visits, navigation, and use. Cookies personalize content and ads, provide social media features, enable multimedia functions, and analyze website data. The collected data is used by IZOLYATSIA to implement the project. Data may also be accessed by the European Union and other donors per their defined conditions, which are beyond IZOLYATSIA’s control. Project implementation may involve interactive social features (e.g., "like," "share") for data analysis, dissemination, content and functionality optimization, and technical issue resolution.

The processing of individuals' data — name, phone number, email, etc. — is carried out in accordance with Ukrainian law and the user’s consent, provided during registration by confirming agreement to the terms. Data collected during account creation is used by IZOLYATSIA to improve project management and promote platform services, including through email communication.

Data usage includes sharing with parties contractually involved in the projects and, as needed, with the European Union and other donors, particularly for reporting. For project-related reporting, data may also be shared with tax authorities, auditors, independent evaluators, and EU- or donor-appointed monitoring personnel.
